RESUMO:

The prior, free and informed consultation is a right guaranteed through OIT Convention 169. Constantly traditional, quilombola and indigenous communities are neglected in view of the possibility of ventures in territories that affect their culture and way of life. With this research will be investigated if the consultation protocols produced by the indigenous, quilombolas and fishermen that may be affected by the construction of the port terminal in Lago do Maicá in Santarém/PA, are instruments that facilitate the realization of the fundamental right to free consultation and informed. To achieve this objective, it is intended to discuss the OIT Convention 169, highlighting the history, legal nature, subjects and applicability; demonstrate the material fundamentality of the right to prior, free and informed consultation; present international experiences on the exercise of the right to prior, free and informed consultation; to analyze the consultation protocols produced by indigenous people, quilombolas and fishermen that may be affected by the construction of the port terminal at Lago do Maicá in Santarém/PA. The research questions whether the consultation protocols produced by the indigenous people, quilombolas and fishermen that may be affected by the construction of the port terminal on Lake Maica in Santarém / PA, are means that facilitate the realization of the fundamental right to prior, free and informed consultation. It is a qualitative, bibliographical, applied research that uses the hypothetical deductive method.
