BIG AREA: Ciências Sociais Aplicadas
AREA: Direito
SUMMARY:

The Cabana’s Land case is a judicialized case of collective conflict about the dispute over an area in the City of Benevides, in the State of Pará, where a private company, called CCS, claims ownership of the area already occupied by several families, who identify themselves as the “MST”, and other groups that prefer not to adopt the same identity, which are The Nelson Mandela I, II and III occupations, which reveals a heterogeneity of actors and interesting legal and social elements to better understand the dynamics of agrarian and land conflicts. Since it is necessary to dive not only into normative instruments, but also into the sociological aspects of the conflict involving Cabana’s Land, this change of perspective is expected to be able to understand the development of creative and consensual paths or methodologies for the outcome of the dispute, with the participation of all actors involved as protagonists. The work has the general objective of analyzing theoretical-methodological paths of self-composition used in the Cabana’s Land case that can contribute to a better understanding of collective conflicts of this nature, as well as whether the use of these self-composition methodologies is possible to reveal a contribution to reducing the inequality of forces between the actors involved, and how the Judiciary is structured to act in the case. The methodology will be based on the existing bibliographic review on the use of self-compounding means of dealing with collective conflicts, and a case study through interviews with actors involved in the Cabana’s Land case as agents of the Judiciary through “CEJUSC”, of the Federal University of the State of Pará , from Cabana’s Land (MST), Nelson Mandela I, II and III, to understand the narratives about the conflict. It is expected to obtain, as a result, the methodological learning of acting through the self-compositive methodologies already known, studied and applied in the Land Cabana’s case, revealing its weaknesses and strengths as well as the Judiciary's intervention strategies through CEJUSC with the actors involved.
