SUMMARY:

Pregnancy and childbirth are important moments in the life of a woman and her family. The constitution of modern obstetric care is marked by a view of pregnancy as pathological and necessary for interventions. In addition, there are several reports of violence during care - disrespect, mistreatment or obstetric violence (V.O). These behaviors are considered a violation of women's fundamental human rights and a reality in the health care of women in labor. As a way of tackling this problem, over the last 30 years, the federal government created public health policies that guarantee dignified, quality and violence-free births. Not only childbirth, but the humanization of all health care for pregnant women. However, since 2013 there has been an increasing creation and promulgation of specific state and municipal legislation on the subject, which arouses interest in understanding this legislative phenomenon that has been gaining ground, above all, because our municipality of Santarém, a city in the west of Pará, has developed and approved municipal law No. 21,101/2020, which aims to provide the right to humanized birth in public health establishments in the municipality. In this sense, the research's general objective is to analyze the relationship between laws that specifically address the right to humanized birth and state public health policies. This is a bibliographical research with a qualitative approach, applied in nature, and initially has an exploratory character, as it aims to deepen the study of public policies aimed at the qualification and humanization of obstetric care, to later advance to an explanatory character, since focuses on identifying the “factors that determine or contribute to the occurrence of phenomena” (GIL, 2012, p. 28-29), that is, the creation of specific state laws on the right to humanized birth. Its method is dialectics and the philosophical current of historical-dialectical materialism. Data collection instruments are diverse. As partial results, it is observed that although there is no Federal Law that specifically regulates the right to humanized birth, there are a series of public health programs and policies to improve health care for pregnant women and that guarantee such right. 14 (fourteen) federative entities have specific state laws on humanization, as well as the municipality of Santarém.
