SUMMARY:

This dissertation aims to analyze the phenomenon of judicialization of the right to health, especially with regard to the supply of medicines, in the Court of Justice of the State of Pará - Comarca de Santarém, headquarters of the metropolitan region that comprises the municipalities of Santarém, Belterra and Mojuí dos Campos, in western Pará. The study precedes an interdisciplinary approach, which rescues the historical-cultural conception of health; the historical trajectory of the evolution of fundamental social rights; addresses the right to health and the model of the Brazilian public health system until its configuration in the Federal Constitution of 1988, which led to the creation of the Unified Health System (SUS) and its implementation through public policies; the legal normative structure that regulates the matter, and also, seeks to elucidate the elements involved in the phenomenon of the judicialization of health in the provision of pharmaceutical care, taking into account the arguments and legal reasoning of the Judiciary of Pará, in the District of Santarém. This is a bibliographic and documentary study, based on primary data, with a quantitative and qualitative approach. The bibliographic research was developed from a Systematic Literature Review (RSL) in the scopus database of works related to judicialization, right to health and supply of medicines. The documentary research is exploratory and descriptive with content analysis by Bardin (2017) for the treatment of data collected from lawsuits filed against the Health Department of the State of Pará and the Municipal Health Departments linked to the municipalities of Santarém, Belterra and Mojuí dos Campos in the period from 2018 to 2020, obtained from the website of the Court of Justice of the State of Pará. The preliminary analysis of the study demonstrates a range of literature focused on for research on the judicialization of the right to health and obtaining medicines, however, even though there is a vast scientific and normative production on the subject, it was found that it is necessary to stimulate the multidisciplinary debate between the health and justice systems, especially around the new contours, discussions and proposals that emerged after the work of the National Council of Justice (CNJ), in the sense of promoting the rationality of the judicialization of health. Despite this being a viable alternative for the realization of the individual's right to health, it is a controversial topic, either because it does not effectively achieve public policies or because it does not propose new implementations.
