Smart and sustainable cities. Regulatory framework.
This document presents strategic information for the various actors in the cities' innovation ecosystem and seeks to demonstrate the status of Brazilian regions in relation to legal support mechanisms for the implementation of city transformation strategies and that consequently lead municipalities to be more efficient in their management and positively impacting the quality of citizen's life, under the concept of smart and sustainable cities. Thus, the document aims to support knowledge for the formulation and implementation of the National Program for Efficiency in Urban Sustainability – PNESU. To this end, the current legislation on the subject of Brazilian municipalities with more than 50 thousand inhabitants was mapped through the websites of the state legislative assemblies and municipal councils, as well as through the Municipal Laws digital platform. Were found 125 regulations, of which 59 deal with the promotion of some of the dimensions of smart and sustainable cities, 44 establish guidelines for the implementation of the smart city model, 13 institute programs that reinforce the consolidation of some of the dimensions, 08 are strictly linked to the regulation of a smart city specifically and 01 concerns the ratification of contracts signed between the State of Maranhão and China for the construction of a smart city. It was concluded that despite the increase in legislative proposals on the subject in recent years, from the total of mapped norms, only 08 came close to what is expected of a Municipal Smart City Plan, which finders financial funding by the Federal Government, as well cooperation between federative entities engaged in programs and projects for smart and sustainable cities.
